Contested or Uncontested Divorce

In Georgia, you can choose between a contested divorce and an uncontested divorce.

  • An uncontested divorce eliminates the need for a trial. You and your spouse reach an agreement on various issues arising from the termination of your marriage, such as the division of custody, property, and the determination of child support and/or alimony.

  • On the other hand, a contested divorce involves a trial. You and your spouse appear in court, presenting evidence to assist the judge in resolving outstanding matters related to custody, property, debt, alimony, or child support.

Ideally, opting for an uncontested divorce is preferable, as it is often less costly and can lead to more favorable outcomes. In an uncontested divorce, you and your spouse, rather than the court, make decisions that directly impact your lives.
